Sunny Hostin’s account of her role in a notorious 1991 murder trial has come under fresh scrutiny after she claimed on The View that she was the lone juror who refused to convict Daniel Rakowitz. Hostin portrayed herself as the decisive holdout, saying she persuaded the other 11 jurors that Rakowitz was not criminally responsible because of his mental state. The story was presented as a personal example of how a single juror can prevent a conviction, with Hostin making clear that she was claiming that role for herself.
The problem is that contemporary accounts of the trial do not match that story. Reports from 1991 identified an unemployed male juror as the main holdout, while another report indicated that Hostin, then known as Asunción Cummings, was one of two jurors pushing for an insanity verdict. Most importantly, Hostin's own comments at the time described the final decision as a compromise and indicated that the jury did not believe Rakowitz had deliberately intended to kill the victim. That is a very different account from the one she has now given. The available contemporary evidence does not support Hostin's claim that she was the lone holdout who single-handedly persuaded the rest of the jury, making her current retelling appear to be a substantially altered version of what actually happened.
